INFORMATION NOTICE TO DATA SUBJECTS
pursuant to Article 13 of Legislative Decree Reg. UE n. 2016/679,
the Personal Data Protection Code (the “Data Protection Code”)

Pursuant to Article 13 of the Data Protection Code and in relation to your personal data (the “Data”), this information notice provides for the following:

 

1 – DATA CONTROLLER
The Data Controller is CAB Costruzioni Aeronautiche Bertola Via S. Venier, 110, 30173 Venezia (VE), Italy.

 

2 – PURPOSES OF DATA PROCESSING

Data generated through access to the website

The computer systems and software procedures used to operate this website acquire, during the course of their normal operation, some personal data, which implicitly need to be sent in order to use internet communication protocols.

This data (such as domain names, IP addresses, the operating system used, the type of browser device used for internet access) is not accompanied by any additional personal data and is used to:

  1. i) Obtain anonymous statistics on the use of the website;
  2. ii) Manage needs to control the methods of use of the same;

iii) Establish responsibility in case of hypothetical computer crimes.

The legal basis that legitimises the processing of such data is the need to make the website functions usable following the user’s access.

 

Data provided voluntarily by the user

The personal data provided by the user through e-mail or other communication is collected and processed for the following purposes:

  1. a) To carry out customer relations activities in accordance with contractual agreements (e.g. giving feedback on requests for information or of a commercial nature, reporting updates, acquiring preliminary information aimed at defining a contractual relationship, proposing commercial offers, providing materials and technical information);
  2. b) For administrative purposes, in order to fulfil activities closely linked and instrumental in managing relations with users as well as to fulfil legal obligations such as those regarding accounting, tax, or to carry out requests put forward by a judicial authority;
  3. c) If curricula vitae are sent, exclusively for selection purposes.

The legal basis that legitimises the processing of such data is either the performance of a contract to which the data subject is party, or the implementation of pre-contractual measures taken in response to the request put forward by the same. In expressly indicated case c., the legal basis is the consent that has been voluntarily given by the data subject.

 

3 – MODALITIES OF DATA PROCESSING
The Data:
(a) will be processed in the manners and according to the procedures that are strictly necessary to meet the Requests and through the operations or set of operations set out in Article 4, paragraph 1, letter (a), of the Data Protection Code;
(b) will be also processed by using electronic or automated tools. The Data will be stored in paper archives located at the registered office of the Data Controller and in electronic archives located both at the said office and at servers in Italy;
(c) will be also processed by using fax, email or any other remote communication technique. The Data Controller also uses the same methods when it discloses the Data to third parties for these purposes, as detailed in paragraph 6 below.
At the same time, the Data will be also processed through the use of cookies (i.e. pieces of information relating to the contents of the Website that the latter sends to the user’s PC system during browsing in order to capture and recall information, with a view to improve the Website).

4 – PROVISION OF THE REQUESTED DATA
Without prejudice to the data subject’s rights, the provision of personal data may be:
– required by Law or Regulation with regard to the purposes referred to in paragraphs 2, letters (a) and (b) above;

  • optional, with regard to the purposes referred to in paragraph 2, letter (c) above.

 

5 – REFUSAL TO PROVIDE DATA
Should you refuse to provide your Data or to give your consent, if required, to their being processed:
– in the cases referred to in paragraphs 4, letters (a) and (c) above, this will make it impossible for the Data Controller to meet the your Requests or with the commercial information regarding the services delivered by the Data Controller.
– in the case referred to in paragraph 4 (b) above, this will make it impossible to provide

to fulfil any contractual commitments undertaken.

 

6 – TRANSMISSION OF DATA
(a) For the purposes referred to in paragraphs 2 (a) and (c) above, or for the discharge of specific obligations required by law, the Data may be transmitted to other subjects and specifically to:
Advisors that help the Data Controller to meet the Requests (e.g. law and tax firms).

 

7 – DISSEMINATION OF DATA
The Data will not be disseminated.

 

8 – TRANSFER OF DATA ABROAD
With reference to the purposes referred to in Article 2 above, the Data will not be transferred to non-EU countries.

 

9 – CONSERVATION PERIOD

The data is retained for the time strictly necessary so as to manage the purposes for which the data itself has been collected in compliance with current applicable legislation and legal obligations.

In any case, CAB Costruzioni Aeronautiche Bertola SNC  implements rules that prevent the indefinite retention of data and therefore limits the conservation period in accordance with the data processing minimisation principle.

 

10 – DATA SUBJECT’S RIGHTS
Under Article 7 of the Data Protection Code, you are entitled to exercise specific rights, including the right to obtain confirmation from the Data Controller as to whether or not personal data relating to you exist and to have them communicated to you in intelligible form. You also have the right to be informed of their origin, as well as of the reasons for, purposes and methods of data processing; to have Data that have been processed in breach of the law erased, changed into an anonymous form or blocked; to have your Data updated, rectified or, if it is in your interest, added to; to object on legitimate grounds to the processing of your Data. You can also appeal the Italian Privacy Autohority.
